Love SwimRun Ltd. Terms and Conditions
These Terms and Conditions relate to ALL Love SwimRun Ltd. events, including Love SwimRun Llanberis, The Big Bala Swim, The Big Welsh Swim, The Secret SwimWalk, The Menai Strait Swim, Pier to Pier Swim.
Please read the following terms and conditions before you apply to enter any Love SwimRun Ltd. event. This document sets out the terms on which you agree to participate in an event. By entering an event, you agree to be bound by these terms and conditions.
1. Definitions and interpretation
In these terms and conditions (Terms), the following definitions shall apply:
‘Administration Cost’
means, where relevant, our reasonable administration costs for organising transfers in accordance with clause 5 of these Terms and as set out in the Event Schedule;
‘Event’
means the event organised by Love SwimRun Ltd. as set out in the Event Schedule;
‘Event Date’
the date or dates on which the event is due to take place, as set out in the Event Schedule;
‘Event Rules’
means the event rules which relate to the operation, safety and fairness of the event which can be found in the Event Schedule;
‘Event Schedule’
means the schedule to these terms which includes specific details about the event (Event Schedules can be found on each specific event website page);
‘Fee’
means the total entry fee payable by you to us as set out in the Event Schedule;
‘Entry’
means the ticket for which you have paid a fee and which is valid for you to participate in a specified event on a specific date as set out in the Event Schedule;
‘Force Majeure Event’
means any condition or event beyond our reasonable control which makes the staging of the event impossible, impracticable or unsafe and which may include: threats or acts of violence, terrorism or war; riots or other forms of civil disorder; public disaster; epidemic; pandemic disease; fire; explosion; strike or lock-out; national grid or local grid failure; absence of power or other essential services; failure of technical facilities; Royal demise or national mourning; any act, order, rule or regulation of any court, government agency or public authority; acts of God; earthquake; rare or unpredictable weather; adverse weather conditions; adverse water quality; or the stopping of the event by the police or by the fire service;
‘Kit Requirements’
means the kit requirements for the event as set out in the Event Schedule;
‘Participant Declaration’
means the declaration that participants must agree to upon entering the event as set out in the Event Schedule;
‘Prize’
means any applicable prize for the event as set out in the Event Schedule;
‘Event Transfer Deadline Date’
means the date set out in the Event Schedule by which you may apply to transfer your entry in the event to a future Love SwimRun Event within the same year;
‘Participant Transfer Deadline Date’
means the date set out in the Event Schedule by which you may apply to transfer your entry in the event;
‘Transferee’
means the person to whom you have transferred your entry where permitted in accordance with clause 5 of these Terms;
‘Organiser’, ‘We’ or ‘Us’
means Love SwimRun Ltd. a company registered in England and Wales (registered company number 11962237). Registered office: 22 Gwynan Park, Dwygyfylchi, Conwy, LL34 6SP; and
‘Participant’, ‘You’ or ‘Your’
means an individual entered into a Love SwimRun Ltd. event.
References to the word ‘include’ or ‘including’ or any similar term are not to be construed as implying any limitation.
2. Event Rules
2.1 Our Event Rules are expressly incorporated into these terms. You must read and understand these rules before applying to enter the event and you must comply with these rules at all times during the event.
2.2 You acknowledge that, due to the nature of the event, we may consider it necessary to change the Event Rules after you apply to enter the event, on the event date or during the event itself. We will make all reasonable efforts to ensure that you are notified of any changes to the Event Rules in writing or in person at the event.
2.3 We may, in our absolute discretion, prevent you from taking part in, or disqualify you from, the event where you do not comply with the Event Rules.
2.4 Each event has its own set of specific rules as set on the Event Schedule (found on each event website page). By entering the event, you accept the rules in full.
2.5. General event rules
These rules apply to ALL Love SwimRun Ltd. events.
(a) You must know the rules and follow these at all times.
(b) You shall respect other participants, Love SwimRun Ltd. officials and volunteers, spectators and the people living in the event location area.
(c) You are not allowed to use unfair methods to get advantages.
(d) You must agree to the Participant Declaration when entering and at registration. Participants who do not agree will not be allowed to enter or to start the race.
(e) You are responsible for collecting any event merchandise on the day of the event or will be responsible for organising alternative methods of collection and any associated costs within 14 days. We may dispose of any unclaimed items at our absolute discretion if this has not been claimed within 14 days following the relevant event.
(f) You must attend registration and briefing in the allotted time or you will forfeit your entry with no refund of entry fee.
(g) You may train and scout the course prior to the race but must respect the local residents and the environment.
(h) You must offer assistance in case of emergency.
(i) If you withdraw from the race, you shall report this as soon as possible to the organisers and return any equipment you have been issued including timing chip and bib number.
(j) Littering will not be tolerated and will result in disqualification.
(k) No external assistance is allowed. You must make your own way from start to finish.
(l) The event courses are in areas open to public. Any disregard for other users (on land or in water) or dangerous or offensive behaviour will result in disqualification.
(m) The use of headphones is prohibited at all times during all of the events.
(n) There are age restrictions for each event as set out in the Event Schedule on the web page for each specific event.
2.6 If there is any conflict between the Event Rules and these terms, these terms will apply.
3. Fee
3.1 In order to participate in the event, you must pay the fee in full. Where you fail to make payment in accordance with this clause 3.1, you will not be able to participate in the Event and you will not be entitled to a refund of any amounts already paid to us.
3.2 Where you apply for a transfer of entry in accordance with clauses 4 and 5 of these terms, we will not refund any difference in cost of the events where the fee for the event you transfer to is lower. If the cost of the event you transfer to is higher you will pay the difference in fee.
3.3 A full and comprehensive summary of each event is contained on the event pages on the website and in the Event Schedule.
3.4 You understand that the Fee covers only the cost of your entry into the event and that it is your responsibility to pay any other additional costs, including but not limited to travel, parking, accommodation and own equipment costs.
3.5 The Fee will not be refunded other than as set out in these terms. In particular, you will not be refunded where you are in breach of these terms and we prevent you from taking part or disqualify you from the event.
3.6 Waiting Lists: where there is a waiting list active on the entry system, this does not effect the Terms and Conditions of your entry. We will not sell on your entry for you or provide you with details of waiting list members.
You may only join the waiting list for one distance option. Joining the waiting list does not guarentee you an entry to the event. We are under no obligation to either offer you a place or to give you an indication of how likely you are to receive an entry. No payment of fee is taken until we offer you an entry and you accept it. We will contact you if an entry becomes available and you must accept it within 24 hours or we will offer it to the next person on the list and delete your waiting list application.
4. Cancellation and rescheduling of the event
Love SwimRun Ltd. goes to great lengths to bring you events that are as safe as possible. The events taking place in open water means we are subject to additional weather risk and other conditions, that means we may have to re-schedule, re-format (i.e.: shorten the course) or cancel an event. Event cancellation insurance is prohibitively expensive and would result in a large entry price increase which is not financially viable.
We bring you these events in utmost good faith and trust that you accept the sharing of this risk with us.
4.1 Where a Force Majeure Event occurs, we may consider it appropriate to cancel, reschedule or relocate the event. In such circumstances we will use reasonable endeavours to inform you of such cancellation, rescheduling or relocation by email using the contact details you provide on entry into the event. Where, given the timing of the Force Majeure Event, it is not practicable to provide you with email notice, we will use reasonable endeavours to provide other methods of notice including mobile phone & text message.
4.2 Where we cancel the event as a result of a Force Majeure Event (and we are not able to reschedule or relocate the Event), we will transfer your entry to the next scheduled iteration of event organised by us (at no cost to you). If you do not want your entry to be transferred to this next iteration of the event, please let us know by the date set out in our written notice to you and we will refund the fee, minus any transaction fees from the Entry provider, to you as soon as reasonably practical. If we have not heard from you by the deadline given, we will be entitled to assume your entry has transferred to the new event.
4.3 Where the Event is rescheduled due to a Force Majeure Event we will transfer your entry to the rescheduled event (at no cost to you). If you do not want your entry to be transferred to the rescheduled event, please let us know by the date set out in our written notice to you and we will refund the fee, minus any transaction fees from the Entry provider, to you as soon as reasonably practical. If we have not heard from you by the deadline given, we will be entitled to assume your entry has transferred to the rescheduled.
4.5 Please write to us using the contact details set out in clause 21.9.
4.6 We will not be liable for any failure to perform our obligations under these terms where such failure is caused by a Force Majeure Event.
4.7 We will not be liable for any incidental costs incurred by you, including travel, accommodation and/or any similar costs where the event is cancelled, rescheduled or reallocated due to a Force Majeure Event.
5. Cancellation by you
5.1 Any confirmed entry that has been deferred from a previous year for any reason is not eligible for a refund or for further deferral. It can be transferred to a Transferee subject to clause 5.
5.2 Cancellation of your online entry can be made in accordance with online selling law up to 14 days after purchase, except where your application is made within two weeks of the event date. Within this time period a refund will be given minus any transaction fees from the Entry provider plus a £10 administration cost.
5.3 For entries purchased WITHOUT Refund Protect, or in cases where Refund Protect does not cover the reason for withdrawal we will not offer a refund. Due to the nature of sports events we are unable to make any exceptions for clash of schedule, illness, injuries or pregnancy.
5.4 Entries purchased WITH Refund Protect (sold through SiEntries)
Refund Protect is an optional membership programme which allows Love SwimRun Ltd. to offer customers an enhanced set of terms of conditions which in circumstances outside of their control enables customers to apply for a refund on non-refundable tickets. Therefore, if the customer cannot attend their event due to an unforeseen circumstance covered by the protection, they would claim for a refund of their transaction fee including booking fees. Details of how to claim against Refund Protect are included on the confirmation email. Before taking out Refund Protect please carefully study details of the scheme at https://www.refundprotect.me/member-wording to ensure it is suitable for your needs. Love SwimRun Ltd. will not offer a refund for any circumstances that are not covered by Refund Protect.
5.5 We regret that we are unable to offer deferrals for participants who find themselves unable to attend an event they have entered, for any reason.
6. Transfers (‘Participant Transfer’ and ‘Event Transfer’)
6.1 Participant Transfer: You may submit a written request to transfer your entry to a Transferee. We will accept such request at our absolute discretion but subject always to the following:
(a) the transfer request must be received by us before the Transfer Deadline Date specified in the Event Schedule;
(b) the Transferee must meet any relevant requirements notified by us to you and the Transferee;
(c) the Transferee must comply with these terms and the Event Rules;
(d) the Transferee is responsible for paying the fee of the event to you if required by you. Love SwimRun Ltd. will not act as agent for any financial transactions. Only the Event Entry is transferred, any additional purchases, including Refund Protect, will not be transferred to the new participant;
(e) you understand and accept that we have no responsibility to find a replacement participant and will not publish details of waiting list participants.
(f) once you have transferred your entry, the Transferee will then own the entry and we will no longer have any obligation to you, regardless of any payment you have made to the us.
6.2 Event Transfer: You may submit a written request to transfer your entry to a future Love SwimRun Ltd. event (this includes changing distance or category within an event to which you are already entered). We will accept such request at our absolute discretion but subject always to the following:
(a) the transfer request must be received by us before the Event Transfer Deadline Date specified in the Event Schedule.
(b) you must meet any relevant requirements notified by us and/or by the new Event Schedule.
(c) you are responsible for paying any difference in the fee of the event to which you apply to transfer to. No refund of any difference in fees will be applicable.
(d) once transferred to the new event you must comply with these terms and the new Event Rules;
(e) you may only transfer your entry once. Thereafter no transfer will be allowed and no refund of any fee will be given.
(f) Event Transfer and distance / category changes can only be made if there is space available on new event / distance / category you request. Acceptance of your request is in no way guaranteed.
7. Our obligations
7.1 We have an obligation to you to ensure that the event is as safe as possible without diminishing the nature of the challenge. However, you acknowledge that your safety and any decisions you make during the event are ultimately your personal responsibility.
8. Event safety
8.1 You acknowledge and accept that the event is a potentially hazardous activity and that your participation in the event may result in serious injury, disablement and/or death to yourself or others.
8.2 You confirm that you are entering the event voluntarily and that you accept the risks associated with your participation in the event.
8.3 By entering the event you declare that you are physically fit and healthy enough to participate in the event. It is your responsibility to declare any medical conditions or injuries that we should be aware of.
8.4 It is your responsibility to ensure you have the necessary experience and capability to undertake the event without endangering yourself or others. By entering the event you confirm that you have such necessary experience and capability and that you are experienced enough to make a reasoned decision as to whether to participate (and continue to participate) in the event and that you will not do so where this may jeopardise your own or another participants’ safety.
8.5 It is strongly recommended that you train for the Event and prepare for the challenge. If you have not exercised before or for some time, you should consult your doctor before commencing your training for the event. We may prevent you from taking part at any time should we, in our absolute discretion, decide that you are not adequately experienced for the event or, upon receipt of medical evidence, we decide that you are not fit to take part in the event.
8.6 You are responsible for your own actions, safety and any injury sustained by you during the Event.
8.7 At all times you must adhere to all instructions given to you by event officials.
8.8 Your participation in the Event is strictly personal to you. You are prohibited from swapping, selling or transferring your entry in the event or allowing another person to register in your place, wear you swim hat, bib number or your timing chip and participate in your place. You may apply for a Transfer of Entry in accordance with clause 6.
8.9 Should you require prescription lenses to ensure adequate vision in normal day to day living it is required that you will wear such lenses whilst participating in the event to ensure that your safety and that of other participants is not compromised.
8.10 Entries from visually impaired swimmers or swimmers that require any other special assistance are welcome, however all such entrants must contact the Organisers prior to entering by email at events@loveswimrun.co.uk and we will be able to find the best way to assist in your participation.
8.11 There are risks of disease and infection from swimming in open water. These include but are not limited to gastrointestinal illnesses, respiratory, skin, ear and eye infections and Weil’s disease. Your participation in the event requires that you accept these risks and that you read the Public Health England (P.H.E.) Swim Healthy leaflet to educate yourself on these risks and how to limit them.
8.12 Whether you have a pre existing medical condition or not, if you feel unwell on the day of the Event then you are advised not to participate in the Event.
9. Waiver, liability and indemnity
Please read this element carefully before accepting these terms and conditions as part of your entry, as this indicates that you are waiving certain legal rights.
If you have any questions consult the event organiser or seek legal advice before proceeding with your online entry to clarify your understanding.
9.1 Provided that nothing shall limit or exclude our liability: for fraud; for death or personal injury caused by our negligence; arising from a deliberate breach of these terms by us; or any other liability to the extent the same may not be excluded or limited as a matter of law you:
(a) assume the risks of participating in the event and, waive, discharge and release us, our officers, employees and contractors from any and all liability, including but not limited to, liability arising from your death, disability, personal injury, property damage, property theft, or actions of any kind which may occur during or in connection with the event.
(b) consent to receiving medical treatment which may be deemed necessary in the event of injury, accident, and/or illness during the event, and neither we, nor our officers, employees or contractors, shall be liable for such treatment;
(c) agree that we shall not be liable for any loss of actual or anticipated income or profits, loss of contracts or for any special, indirect or consequential loss or damage of any kind howsoever arising and whether such loss or damage arises under: tort (including negligence); contract; breach of statutory duty or otherwise, and whether or not such loss or damage is foreseeable, foreseen or known;
(d) agree that our maximum aggregate liability under or in connection with these terms whether such claim arises in: contract; tort (including negligence); breach or statutory duty; or otherwise shall in no circumstances exceed a sum equivalent to the total amount of the Fee paid by you at the date such action or claim arises.
9.2 You shall indemnify and keep us, our officers, employees and contractors indemnified against, all liabilities, costs, expenses, damages and losses (including reasonable legal and other professional costs and expenses) suffered or incurred by us, our officers, employees and contractors arising out of or in connection with your participation in the event and/or any breach by you of these terms or any of the Event Rules.
9.3 You shall also agree to the Participant Declaration specific to each event as set out in the Event Schedule. The Event Schedue and Participant Declaration for each event can be found of its specific web page.
10. Cut off times
10.1 You understand that the Organiser may introduce cut off times as they see fit as part of the event rules, being limits on the time taken to complete sections of the event (in accordance with the Event Schedule) to ensure the safe and proper running of the event. Subsequently, competitors may be instructed to withdraw from the race in accordance with imposed cut off times. The organiser’s decision on this is final.
11. Timing and results
11.1 Love SwimRun Ltd. will use its best endeavours to provide you with an event finish time, however we cannot be held responsible for any computer result anomalies or any technical malfunctions.
12. Prizes
12.1 Where applicable, any prizes for the event will be set out in the Event Schedule.
12.2 Where you win a prize, this will be announced on the day of the event at the prize giving ceremony at the time specified in the Event Schedule. Such prize must be collected on the day of the event. If not collected on the day of the event the Prize must be claimed in writing within 48 hours and any cost of postage must be paid by You before the prize will be delivered. After 48 hours all prizes will be forfeited.
13. Complaints & protests
13.1 A protest must be given in writing to Love SwimRun Ltd. within 24 hours of event results being announced.
13.2 A protest must include: Time and location, Participant number/s, the reason for the protest – If possible include a witness with name and contact details or team number. A protest that does not comply with the above will not be considered.
13.3 The protest will be reviewed by the organisers and a decision communicated to those involved as soon as possible
13.4 We reserve the right to use “common sense” to take decisions about situations that aren’t clear in the rules
13.5 The Organisers decision is final
13.6 All other complaints must be made in writing to Love SwimRun Ltd. See clause 22.9.
14. Medical care
14.1 You agree to complete the medical declaration accurately and honestly at the time of entering the event and then to update us with any changes to your health prior the start of the event should any arise.
14.2 Both professional First Aid services and volunteer First Aiders work at our events. You must understand that any claims brought in respect of negligent treatment must be brought under English Law.
15. Insurance
15.1 You acknowledge that it is your responsibility to obtain appropriate insurance to cover your participation in the Event (and any loss, expenses or injury which may occur as a result of such participation).
16. Your clothing, equipment and belongings
16.1 You must always observe the Compulsory Kit Requirements when participating in the Event. It is your responsibility to ensure that you have appropriate clothing and equipment. We may, in our absolute discretion, prevent you from taking part in, or disqualify you from, the event where you do not have appropriate clothing and equipment. Kit Requirements may change before the start of any event and you are required to ensure you have the equipment and clothing set out in the latest version of the Kit Requirements prior to starting the event.
16.2 We accept no liability for any loss, theft and/or damage to your clothing, equipment or belongings in connection with the event, including where your clothing, equipment and belongings are transported and/or stored as part of the event. Your belongings are left in any Bag Drop entirely at your own risk.
16.3 We may keep any clean lost property for up to seven days after the Event. Wet, soiled and/or dirty lost property will not be kept. The cost of postage to return an item of lost property is payable by you before we return such item. We may dispose of any unclaimed lost property at our absolute discretion if this has not been claimed within seven days following the relevant Event.
17. Equipment we issue to you
17.1 Where we issue any equipment to you, you will be responsible for such equipment. Where you lose such equipment or it is damaged whilst in your possession, for whatever reason, you must promptly pay to us the full replacement cost of such equipment.
17.2 Where you lose or damage any electronic timing devices issued by us to you, you will be charged for its replacement in accordance with the Event Schedule.
18. Children Under 18
18.1 Parent/guardian permission is required for all children under the age of 18 participating in an event. By entering the event online, agreeing to parental consent at point of entry, and paying in advance, agreement to the Parental Consent Agreement (Cluse 18.4) is assumed.
18.2 For all children under the age of 16, a parent/guardian must be present throughout the event the child is participating in. All children must be accompanied on the event course by a parent/guardian. Without a parent/guardian present the child will be unable to participate in their event, without exception.
18.3 Love SwimRun Ltd. reserves the right to refuse any participant entry to an event at the time of registration should the appropriate permissions not be in place by the parent/guardian.
18.4 Parental Consent Agreement
By allowing my child to participate in the event, I, the parent/guardian of the child mentioned above agree and acknowledge that:
(a) I am aware of the inherent element of risk involved in the event undertaken and accept responsibility for exposing my child to such inherent risks.
(b) I have satisfied myself that my child has the necessary skill and knowledge to take part in the event and to deal with conditions that may arise in the course of the event.
(c) I confirm that my child does not have any disability or medical condition, physical or mental, which could affect their ability to participant safely in the event.
(d) I accept responsibility for any injury, damage or loss to the extent caused by my own actions or omissions or actions or omissions of my child.
(e) I will be responsible for my child throughout the event and during the time that they are participating.
(f) I understand that children under the age of 16 must be accompanied by a fee paying parent/guardian throughout the whole duration of the event.
(g) I hereby grant full permission to Love SwimRun Ltd. as the Event Organiser to use any photographs, videotapes, motion pictures, website images, recordings or any other record of my child at the event.
19. Data protection
All data collected for your entry to Love SwimRun Ltd. events is stored securely by SiEntries or Ticket Tailor in accordance with their privacy policies (for SiEntries: https://www.sientries.co.uk/privacy.php, for Ticket Tailor: https://www.tickettailor.com/privacy-policy ). Data is only downloaded and held securely by Love SwimRun Ltd. for a short duration before and during the event, solely for the purpose of organisation and administration of the event:
19.1 For the purposes of these terms, personal information includes medical data collected for health and safety purposes (‘Personal Information’).
19.2 You agree that your Personal Information can be stored, used by the organisers and in connection with the organisation, staging and administration of the event you have entered.
19.3 Medical information will only be used to highlight potential issues in advance and to allow medical assistance to be given on the date of the event
19.4 We shall take all necessary steps to ensure that Personal Information pertaining or relating to you which comes into the possession or control of the organisers or our event partners shall not be:-
(a) used or reproduced in whole or in part in any form except for the purposes outlined in these terms;
(b) disclosed to any person not authorised by you to receive it; or
(c) altered, deleted, added to or otherwise interfered with (except where expressly permitted by these Conditions).
19.5 By agreeing to the Terms you will receive a limited number of emails which will include information and offers to help you prepare for the Event and latest updates on the event itself.
19.6 After the event you may also receive marketing emails informing you of the next iteration of the event you took part in or of other events organised by us. You can opt out of receiving these at any time.
19.7 Financial Transactions: Payments for events are completed via SiEntries or Ticket Tailor (Stripe), and the payment information you submit is collected and used by them in accordance with their privacy policies (for SiEntries https://www.sientries.co.uk/privacy.php). Adhoc sales for equipment and sundries relating to events are completed also via PayPal or Stripe, and the payment information you submit is collected and used by them in accordance with their privacy policies (for PayPal: https://www.paypal.com/uk/webapps/mpp/ua/privacy-full, for Stripe: https://stripe.com/gb/privacy). Love SwimRun Ltd. does not collect or store any information relating to your credit or debit cards. Rarely, we may ask you for your banking information (sort code and account number) to process a refund or other payment to you directly.
20. Event photography / film (Recordings)
20.1 We may film or photograph you during the event. You hereby consent to us taking such Recordings and give your consent to us to use such Recordings in any way we see fit, in all media, in any form, worldwide and in perpetuity.
20.2 You hereby irrevocably grant Love SwimRun Ltd. permission and consent to use such Recordings for any legitimate purpose including, without limitation, any commercial purpose, without compensation to you.
20.3 You further waive any right of inspection of any such recordings and photographs. You understand that any such recordings shall become the sole property of Love SwimRun Ltd. as applicable.
21. Parking
21.1 You are wholly responsible for assessing the suitability of the car park at the event and the suitability of your vehicle for accessing and egressing the car park.
21.2 Any vehicle parked in the car park at the event, and any contents left within vehicles, shall be left at your own risk. We accept no liability whatsoever for any damage or loss to any vehicles or any contents left within vehicles, however caused.
21.3 You are wholly responsible for any parking charges made for car parking and for any charges arising from your non-payment of said charges.
22. General
22.1 If you do not comply with or otherwise breach these Terms or Event Rules:
(a) we will disqualify you from the event and you shall not receive a refund on any part of the fee; and
(b) we also reserve the right to exclude you from participation in any future events we organise.
22.2 These terms are subject to change in relation to future events. All changes shall be published on our website, and we advise you to review these carefully before signing up to any additional events.
22.3 The nature of the event is described on the event website; however, you acknowledge and accept that the duration, distance, height gain, support points, checkpoint locations, cut-off times and course closure times are subject to change.
22.4 If any court or competent authority finds that any provision of these terms is invalid, illegal or unenforceable, that provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these Terms shall not be affected. If any invalid, unenforceable or illegal provision of these terms would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
22.5 A waiver of any right or remedy under these Terms is only effective if given in writing and shall not be deemed a waiver of any subsequent right or remedy. No failure or delay by us to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.
22.6 These Terms constitute the entire agreement between us both and supersede all previous agreements, promises, assurances, warranties, representations and undertakings between us, whether written or oral relating to its subject matter.
22.7 These Terms do not confer any rights on any person or party (other than the parties to these Terms) under the Contracts (Rights of Third Parties) Act 1999.
22.8 These Terms shall be governed by and construed in all respects in accordance with the law of England and any disputes relating to or arising from these Terms or the event shall be subject to the exclusive jurisdiction of the English courts.
